Readers may recall that the Commission recently heard a complaint against FortisAlberta’s Payment in Lieu of notice charge by BURNCO rock products. That particular proceeding is still awaiting a decision by the AUC, however, the Commission recently (February 9, 2018) decided on a similar complaint by a hay processing plant (Dalziel Enterprises).

On July 27, 2017 BURNCO Rock Products Ltd submitted a complaint against FortisAlberta because of a “Customer Exit Charge” levied against the company when it cancelled service at two of its sites. BURNCO argues that the charge means Fortis is recovering costs that were already recovered through the particular arrangements of the service contracts.
